IMPORTANT — READ THIS ENTIRE DOCUMENT CAREFULLY BEFORE SIGNING
This Waiver, Release of Liability, Assumption of Risk and Indemnification Agreement ("Agreement") is a legally binding contract entered into by the undersigned individual ("Participant" or "Attendee") in favour of all of the following:
(a) Nathan Hao Jin Koo, an individual operating under the event name 6CUPS, together with their volunteers, helpers, agents, sponsors, and representatives (collectively, the "Event Organizer");
(b) Nickel 9 Distillery Inc., operating as Nickel 9 Distillery, located at 90 Cawthra Avenue, Unit 100, Toronto, Ontario, M6N 3C2, and its owners, operators, directors, officers, managers, employees, agents, servants, and licensees (the "Venue");
(The Event Organizer and the Venue, together with all associated sponsors, partners, and third-party service providers connected to the Event, are referred to collectively as the "Released Parties.")
"Released Parties" means every person and entity listed above — they are the parties you are releasing from liability by signing this Agreement. In plain language: by signing, you are giving up your right to sue them.
BY SIGNING THIS AGREEMENT, THE PARTICIPANT ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREE TO ALL TERMS BELOW. THE PARTICIPANT IS GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE ANY RELEASED PARTY. IF YOU DO NOT AGREE TO EVERY TERM, DO NOT SIGN AND DO NOT ENTER THE EVENT.The 6CUPS Beer Pong Tournament, "TABLE ZERO" ("the Event") is a competitive recreational beer pong tournament taking place on March 22, 2026, at the Venue located at 90 Cawthra Avenue, Toronto, Ontario. The Event involves, but is not limited to: the consumption of alcoholic beverages, competitive beer pong gameplay, physical activity, standing, moving through crowded indoor spaces, and the use of shared equipment including ping pong balls, cups, and tables.
This Agreement applies to ALL persons who enter the Venue on the date of the Event regardless of their role or capacity, including but not limited to: active tournament players, substitutes, team supporters, spectators, guests, bystanders, and any other person present on the premises. Every such person is a "Participant" or "Attendee" for purposes of this Agreement.
This Agreement is also incorporated by reference to the 6CUPS Event Rules & Safety Guidelines ("Rules Document"), a copy of which has been made available to the Participant prior to signing. By signing this Agreement, the Participant confirms they have read and agree to the Rules Document in its entirety.In consideration of being granted the right to attend and participate in the Event — including but not limited to: access to the Venue and its facilities, the right to compete in the tournament, the opportunity to win prizes, access to food and beverages, and participation in the social and competitive atmosphere of the Event — the receipt and sufficiency of which consideration is hereby acknowledged, the Participant agrees to all terms and conditions of this Agreement. The Participant affirms that this consideration is adequate, fair, and that this Agreement is supported by good and valuable consideration exchanged between the parties.
The Participant represents, warrants, and confirms under penalty of breach that: They are 19 years of age or older as required under the Liquor Licence and Control Act, R.S.O. 1990, c. L.19, and the laws of the Province of Ontario; They will present valid government-issued photo identification (driver's licence, passport, or provincial ID card) upon request at the entrance to the Venue, and they understand that failure to produce satisfactory ID will result in immediate denial of entry or removal from the Venue without refund and without liability to any Released Party; All personal information provided by the Participant at the time of signing this Agreement — including but not limited to their legal name, date of birth, age, email address, and phone number — is true, accurate, complete, and not misleading; Providing false or misleading information, including misrepresenting age or identity, constitutes a material breach of this Agreement. However, such a breach does NOT void or invalidate the waiver, release, and indemnification provisions of this Agreement — those provisions remain in full force and effect regardless of any misrepresentation by the Participant; The Participant has not been refused entry to any licensed premises for behaviour-related reasons within the past 12 months.
The Participant freely, voluntarily, knowingly, and with full understanding of the consequences, acknowledges and accepts all inherent risks associated with the Event, including but not limited to: Risks associated with the voluntary consumption of alcoholic beverages, including intoxication, impairment of judgment and physical coordination, disorientation, nausea, adverse physical reactions, injury caused by reduced inhibition, and any other consequences of becoming intoxicated; Slipping, tripping, stumbling, or falling due to wet or slippery floors, spilled beverages, crowding, uneven surfaces, low lighting, or obstacles within the Venue; Collision with or injury caused by other participants, spectators, furniture, equipment, balls, cups, or the physical environment of the Venue; Bodily injury, illness, or property damage arising from participation in beer pong, including being struck by a ping pong ball; Exposure to communicable illnesses, including but not limited to COVID-19, influenza, or other pathogens, arising from attendance at an indoor public event with multiple individuals in close proximity; Injury or damage caused by the actions, inactions, negligence, or misconduct of other participants, spectators, or third parties not under the direct control of the Released Parties; Risks related to the Participant's own physical condition, pre-existing health conditions, disabilities, or medical history, including adverse reactions to alcohol consumption; Risks arising from attending the Event having already consumed alcohol prior to arrival — the Participant expressly acknowledges that arriving at the Event in an impaired or partially impaired state increases their personal risk and that they assume full responsibility for any consequences arising from pre-Event alcohol consumption; Risks arising from transportation to or from the Event, including risks associated with travelling while impaired; Any other risks, whether foreseeable or unforeseeable, inherent to attendance at a competitive social event involving alcohol consumption in a crowded indoor licensed venue. The Participant acknowledges that the above list is illustrative and not exhaustive. The Participant accepts all known and unknown risks as a condition of entry and participation in the Event, without reservation.
To the fullest and maximum extent permitted by the laws of the Province of Ontario, the Participant — for themselves and on behalf of their heirs, next of kin, executors, administrators, personal representatives, and assigns — hereby IRREVOCABLY WAIVES, RELEASES, AND FOREVER DISCHARGES all Released Parties from any and all claims, demands, actions, causes of action, damages, losses, expenses, costs, and liabilities of every nature and kind ("Claims"), whether known or unknown, present or future, anticipated or unanticipated, arising directly or indirectly out of or in connection with:
The Participant's attendance at or participation in the Event in any capacity whatsoever;
The voluntary consumption of alcoholic beverages by the Participant at, before, or in connection with the Event;
Any bodily injury, psychological injury, illness, death, property damage, or loss suffered by the Participant in connection with the Event;
The ordinary negligence of any Released Party, including their employees, volunteers, agents, or contractors — including negligence in the supervision, management, or operation of the Event or Venue;
Any failure by a Released Party to maintain, inspect, or repair any equipment, facility, or surface at the Venue;
The conduct, acts, or omissions of other attendees, participants, or third parties at the Event;
Conditions existing at the Venue, including the physical environment, layout, lighting, floors, equipment, seating, or facilities;
Any decision by a Released Party regarding alcohol service, including refusal of service or removal from the Venue.
GROSS NEGLIGENCE AND INTENTIONAL MISCONDUCT: For clarity and to ensure the enforceability of this Agreement under Ontario law, this Release does NOT purport to release any Released Party from liability arising from their own gross negligence or intentional/wilful misconduct. All Claims arising from ordinary negligence are fully, completely, and irrevocably released. The Participant expressly understands this distinction.
The Participant unconditionally agrees not to commence, maintain, or support any legal claim, action, or proceeding against any Released Party in connection with any matter covered by this Agreement.The Participant agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS all Released Parties from and against any and all Claims, losses, liabilities, damages, costs, and legal expenses (including reasonable solicitor-client legal fees on a full indemnity basis) brought by any person — including third parties — arising out of or relating to: The Participant's attendance at, participation in, or conduct during the Event; Any breach by the Participant of any term or representation made in this Agreement; Any act, omission, negligence, recklessness, or intentional misconduct by the Participant that causes injury, damage, or loss to any other person or to any Released Party; The Participant's misrepresentation of their age, identity, or sobriety in connection with the Event; The Participant's arrival at the Event in an impaired state and any harm that arises therefrom.
The Participant acknowledges and agrees to each of the following, with full awareness of their legal significance: ARRIVING IMPAIRED: The Participant understands that arriving at the Event already impaired by alcohol or any other substance increases their personal risk. By choosing to enter the Venue in an impaired state, the Participant expressly and voluntarily assumes all risks associated with that impairment. The Released Parties shall bear no liability whatsoever for any injury, loss, or damage arising from or contributed to by the Participant's pre-existing impairment at the time of entry; CHOOSING TO DRINK: The Participant understands that the consumption of alcohol at the Event is entirely voluntary. By choosing to consume alcohol, the Participant voluntarily assumes all risks associated with that consumption, including but not limited to becoming intoxicated, impairing their own judgment and coordination, and any resulting injury or harm. The Participant's voluntary decision to consume alcohol extinguishes any claim they may otherwise have against the Released Parties for harms arising from or contributed to by their own intoxication; PERSONAL RESPONSIBILITY: The Participant is solely and entirely responsible for monitoring, managing, and limiting their own alcohol consumption throughout the Event; NO IMPAIRED DRIVING: The Participant commits to not operating a motor vehicle or any machinery while impaired. The Participant agrees to arrange safe, sober transportation home prior to attending the Event. The Released Parties bear no responsibility for the Participant's transportation decisions before, during, or after the Event; SMART SERVE COMPLIANCE: The Venue staff are Smart Serve certified and are legally obligated under the Liquor Licence and Control Act to refuse service to any person who is or appears to be intoxicated. The Participant agrees to comply with all service decisions made by Venue staff, to accurately represent their level of intoxication, and not to circumvent any service refusal; RIGHT TO REFUSE AND REMOVE: The Released Parties reserve the unconditional right to refuse alcohol service to or remove from the Venue any Participant at any time, for any reason including apparent intoxication, without liability, refund, or obligation to the Participant.
As a condition of entry to the Event, the Participant agrees to: Read, understand, and comply at all times with the 6CUPS Event Rules & Safety Guidelines, incorporated herein by reference; Follow all instructions issued by the Event Organizer, Venue staff, volunteers, or any person in an official capacity at the Event; Conduct themselves in a respectful, lawful, safe, and non-threatening manner toward all other participants, staff, volunteers, and third parties; Refrain from any form of violent, aggressive, threatening, abusive, discriminatory, or illegal behaviour; Not tamper with, damage, destroy, or misuse any Venue property, equipment, or fixtures; Not bring or consume alcohol obtained from outside the licensed Venue premises; Not facilitate or encourage any underage person to enter the Venue or obtain alcohol. The Released Parties reserve the unconditional right to remove any Participant from the Event at any time, for any conduct they deem disruptive, dangerous, offensive, or contrary to the rules of the Event, without refund and without any liability whatsoever to the Participant.
As an absolute condition precedent to the commencement of any legal proceeding against any Released Party, the Participant agrees to: Provide written notice to the Event Organizer of any incident, injury, or potential claim within thirty (30) calendar days of the date of the Event (i.e., by April 21, 2026), sent by email to the Event Organizer's contact address as provided at the Event; Include in such notice a description of the incident, the nature of the alleged injury or damage, and the identity of any witnesses; Allow the Released Parties a reasonable period to investigate and respond to the notice before commencing any legal action. Failure to provide timely written notice in accordance with this section shall operate as a complete and absolute bar to any claim against any Released Party, to the fullest extent permitted by Ontario law. This contractual limitation does not extend or modify any applicable statutory limitation period.
By signing this Agreement and attending the Event, the Participant irrevocably consents to being photographed, filmed, recorded, or otherwise captured (in any media format now known or hereafter developed) at the Event for promotional, marketing, archival, or social media purposes by the Event Organizer or their designated representatives, without compensation to the Participant. The Participant waives any right to inspect, approve, or receive compensation for such use of their name, image, voice, or likeness. Opt-Out Option: If the Participant does NOT consent to being photographed or filmed, they must check the box below at the time of signing AND notify Event Organizer staff in person at the entrance to the Venue. The Event Organizer will make commercially reasonable efforts to exclude opted-out Participants from published media but cannot guarantee exclusion from all incidental background recordings made by other attendees. Opting out of photography has no effect on any other provision of this Agreement.
In the event that the Participant requires emergency medical attention during the Event and is unable to provide informed consent at the time, the Participant hereby authorizes the Released Parties and emergency medical personnel to take all reasonable and necessary steps to obtain emergency medical care on their behalf. The Participant acknowledges that neither the Event Organizer nor the Venue is responsible for the cost of any such emergency medical treatment, and the Participant releases all Released Parties from any liability arising from emergency medical decisions made in good faith on their behalf. The Participant agrees to disclose any known allergies, medical conditions, or medications that could affect emergency treatment by notifying Event Organizer staff at the Venue entrance.
If this Agreement is signed electronically or through a digital waiver platform, the Participant acknowledges and irrevocably agrees that: Their electronic signature constitutes a valid, binding, and fully enforceable signature to the same extent as a handwritten wet signature, in accordance with the Electronic Commerce Act, 2000, S.O. 2000, c. 17; They are personally and individually executing this Agreement and have not authorized, permitted, or allowed any other person to sign this Agreement on their behalf; The combination of their electronic signature, the timestamp of signing, and the IP address recorded at the time of signing constitutes sufficient and adequate evidence of their identity, age, capacity, and consent to be bound by this Agreement; Their signed record will be retained by the Event Organizer and may be produced as evidence in any legal or administrative proceeding; Physical government-issued photo ID verification at the Venue entrance is a separate and independent requirement that is distinct from electronic pre-signing — both are mandatory conditions of entry, and signing the waiver electronically does not guarantee admission if ID cannot be produced at the door; They acknowledge that the Released Parties will cross-reference the name on the digital waiver with the name on their government-issued ID at the Venue entrance.
The Participant expressly understands that this Agreement governs only Claims brought by the Participant against the Released Parties. This Agreement does not release any third party from liability to the Participant. The Released Parties are not responsible for the independent actions, behaviour, or misconduct of other attendees at the Event, and each individual attendee bears personal responsibility for their own conduct. Nothing in this Agreement creates or implies any duty of care by the Released Parties that is not already established under applicable Ontario law.
The Participant is aware of the Occupiers' Liability Act, R.S.O. 1990, c. O.2. The Participant acknowledges that the Venue has taken reasonable steps to make the premises reasonably safe. The Participant further acknowledges that by voluntarily entering the Venue and participating in an event that involves the consumption of alcohol and recreational physical activity, they have willingly assumed the risks described in Section 4 of this Agreement, and that such voluntary assumption of risk is a complete defence available to the Released Parties under Section 4(1) of the Occupiers' Liability Act.
If any provision or part thereof of this Agreement is found to be invalid, void, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from this Agreement and the remaining provisions shall continue in full force and effect, unaffected by such severance. It is the express intention of the parties that this Agreement be construed and applied as broadly as possible to protect the Released Parties to the maximum extent permitted by applicable law. No invalidity of one provision shall affect the validity of any other provision.
This Agreement shall be governed exclusively by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada as applied therein, without regard to conflict of laws principles. Any dispute, claim, or proceeding arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, sitting in the City of Toronto. The Participant irrevocably and unconditionally submits to such jurisdiction and waives any objection to the laying of venue or any claim that such courts are an inconvenient forum.
This Agreement, together with the 6CUPS Event Rules & Safety Guidelines incorporated by reference herein, constitutes the entire agreement between the Participant and the Released Parties with respect to the subject matter hereof. It supersedes all prior and contemporaneous discussions, negotiations, representations, and agreements, whether oral or written, relating to the same subject matter. No amendment, modification, or waiver of any provision of this Agreement shall be valid or binding unless made in writing and signed by both the Participant and the Event Organizer.
THE PARTICIPANT EXPRESSLY, FREELY, AND VOLUNTARILY ACKNOWLEDGES AND CONFIRMS EACH OF THE FOLLOWING: They have been given adequate time and opportunity to read this Agreement in its entirety — including every section — before signing; They have read, understood, and fully comprehend the content and legal effect of every section of this Agreement; They have been expressly advised and have had the opportunity to seek independent legal advice before signing, and have either obtained such advice or have knowingly, freely, and voluntarily waived their right to do so; They are signing this Agreement freely, voluntarily, and without duress, coercion, undue influence, misrepresentation, or pressure of any kind from any Released Party; They understand with certainty that by signing this Agreement, they are permanently waiving substantial legal rights, including but not limited to the right to sue, make a claim against, or seek compensation from any Released Party for negligence arising from the Event; This Agreement is binding upon themselves personally and upon their heirs, estate, executors, administrators, personal representatives, and assigns; No representations have been made to them by any Released Party that are not contained in this Agreement, and they have not relied on any such representations.

These Rules & Safety Guidelines ("Rules") apply to every person who enters the Event venue on March 22, 2026, in any capacity. By signing the 6CUPS Event Waiver, you confirm that you have read and agree to comply with every rule in this document. Failure to comply may result in immediate removal from the Venue without refund.These Rules apply to all attendees — whether you are an active player, a team supporter, a spectator, a friend of a player, or simply present on the premises. Everyone inside the Venue on the date of the Event is bound by these Rules.
This Event is strictly 19+. No exceptions will be made for any reason. You must present valid, government-issued photo ID at the door. Acceptable ID includes: Ontario Driver's Licence, Canadian Passport, NEXUS card, or a provincially-issued photo ID card. Any person who cannot produce valid ID will be refused entry. No refunds will be issued. Any person who misrepresents their age or attempts to use false ID will be removed immediately. This constitutes a criminal offence in Canada.
CRITICAL: If you choose to arrive at this Event having already consumed alcohol, you are doing so voluntarily and at your own risk. You must be capable of making a sober, informed decision to sign the Event Waiver at the time of entry. If you are unable to do so due to prior intoxication, you will be denied entry. If you arrive in a visibly intoxicated state, Venue staff and Event Organizer staff reserve the right to deny you entry. This is a legal requirement under the Liquor Licence and Control Act. By choosing to attend this Event after having consumed alcohol elsewhere, you voluntarily accept all risks associated with your pre-existing impairment. The Event Organizer and Venue bear zero responsibility for any harm, injury, or incident that is caused by or contributed to by alcohol you consumed before arriving. You are required to honestly represent your sobriety level to staff upon request. Misrepresenting your level of intoxication to gain entry is a breach of your Waiver and these Rules.
CRITICAL: Drinking at this Event is entirely voluntary. If you choose to drink, you accept all risks that come with that choice. All alcohol served at the Event is provided and controlled by the licensed Venue in compliance with the Liquor Licence and Control Act, R.S.O. 1990, c. L.19. You are the only person responsible for deciding how much alcohol you consume. The Released Parties are not responsible for your decision to drink or for the consequences of your drinking. By choosing to consume alcohol at this Event, you voluntarily assume all risks associated with becoming intoxicated, including impaired judgment, reduced coordination, increased risk of injury, and any other physical or psychological consequences. Your voluntary decision to drink eliminates and extinguishes any claim you may have against the Released Parties for any harm arising from or contributed to by your own intoxication. You must not attempt to obtain alcohol by misrepresenting your sobriety to Venue staff. You must not bring outside alcohol onto the Venue premises. Only alcohol served by the licensed Venue may be consumed on the premises. Venue staff are Smart Serve certified and legally obligated to cut off service to anyone who appears intoxicated. If you are refused service, you must accept that decision immediately and without argument. The Venue reserves the right to remove any person from the premises who is visibly intoxicated or behaving in a manner that suggests impairment.
DO NOT DRIVE AFTER THIS EVENT IF YOU HAVE CONSUMED ALCOHOL. Plan your ride home BEFORE you arrive. You must not operate a motor vehicle, bicycle, scooter, or any motorized device after consuming alcohol at this Event. The Released Parties strongly encourage all attendees to pre-arrange a designated driver, use a rideshare app (Uber, Lyft), take public transit (TTC), or call a taxi. The Released Parties are not responsible for your transportation decisions before, during, or after the Event. You are solely responsible for how you get home safely. If Venue staff observe a visibly intoxicated person attempting to drive, they are legally obligated to attempt to prevent this. This is not a courtesy — it is a legal duty under Ontario law.
All gameplay decisions made by Event Organizer staff or designated referees are final. No arguments, disputes, or appeals will be entertained after a ruling is made. Players must remain behind the edge of their designated table at all times during active play. Leaning over the table is not permitted except during a designated "elbow" or "wrist" rule, as announced. Balls must be retrieved promptly and carefully. Do not throw or toss balls in the general crowd area. Cups must be arranged as directed by Event staff at the start of each game. Re-racks are permitted as specified by the Event Organizer — staff will announce re-rack rules before play begins. Any deliberate interference with another team's gameplay will result in an immediate forfeit of the game. Unsportsmanlike conduct — including trash talking that becomes threatening, aggressive physical gestures, deliberate distraction tactics, or cheating — will result in disqualification from the tournament. Tournament brackets and scheduling are at the sole discretion of the Event Organizer. Schedule changes may occur.
Be aware of your surroundings at all times. The Event takes place in a crowded indoor environment. Watch for spilled liquids on the floor. If you observe a spill, notify Event or Venue staff immediately. Do not attempt to clean it up yourself in a way that could create further hazard. Do not run, push, shove, or engage in any physical horseplay inside the Venue. If you feel unwell, dizzy, or otherwise physically impaired at any time, remove yourself from active gameplay and notify staff immediately. Emergency exits are clearly marked throughout the Venue. Familiarize yourself with your nearest exit upon arrival. In the event of an emergency, follow all instructions from Venue staff and emergency services personnel immediately.
All attendees are expected to treat each other, Event staff, and Venue staff with respect at all times. Harassment, intimidation, verbal abuse, or discrimination of any kind — based on race, gender, sexual orientation, religion, disability, or any other characteristic — will result in immediate removal from the Venue and potential involvement of law enforcement. Any form of physical violence, assault, or threatening behaviour will result in immediate removal, a permanent ban from future 6CUPS events, and referral to police. Damage to Venue property, equipment, or furnishings is the personal financial responsibility of the person who caused the damage. The Event Organizer and Venue staff decisions regarding conduct are final. Anyone asked to leave must do so immediately and without argument.
The Event will be photographed and filmed for promotional purposes. If you do not consent to being photographed, you must opt out by checking the box on your Waiver and notifying staff at entry. All attendees consent to appearing in crowd/ambient footage captured during the Event unless they have formally opted out. You may take personal photos and videos at the Event. However, posting content that is defamatory, harassing, or that depicts anyone in a degrading or non-consensual manner is strictly prohibited and may have legal consequences.
The Event Organizer and Venue reserve the unconditional right to remove any person from the Event at any time, without prior warning, for any violation of these Rules or for any behaviour deemed unsafe, disruptive, threatening, or contrary to the spirit of the Event. Persons removed from the Event: Will not be entitled to any refund of any entry fee, registration cost, or other payment; Will not be permitted to re-enter the Venue on the date of the Event; May be banned from future 6CUPS events at the sole discretion of the Event Organizer; May be subject to referral to law enforcement if their conduct warrants it.
If you witness or experience a medical emergency, immediately notify the nearest Venue staff member or call 9-1-1. Do not attempt to move an injured person unless there is an immediate and obvious physical danger to leaving them in place. Event staff are not medical professionals. Their role in a medical situation is to call for professional help and assist in maintaining a safe environment until emergency services arrive. If you have a known medical condition, severe allergy, or are on medication that could be affected by alcohol consumption, you are responsible for taking appropriate precautions and informing Event staff upon arrival if necessary.
BY SIGNING THE 6CUPS EVENT WAIVER, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO COMPLY WITH EVERY RULE IN THIS DOCUMENT.
